USER AGREEMENT

By accessing or registering for this site you agree to all the terms disclosed in this User Agreement.

We reserve the right to change the User Agreement terms without notice. Such changes will take effect immediately upon posting on the web site.

You may not share the provided data, content, methods, processes, formulations, or practices contained within the site, collectively referred to as Site Content with other unregistered users. Also, you may not assign, transfer, license or sub-lease, your account or account access information to another user or entity.

We offer several commercial options for accessing Site Content including customized web solutions, XML base web services delivery, and in-house hosted option.

You may not modify, copy, extract, distribute, transmit, display, reproduce, publish, license, sell, attempt to reformulate or reverse engineer any Site Content or incorporated into other work whether software, product, service, print, or other without obtaining advanced written authorization. Any violation may be prosecuted as provided by law.

Registered users agree to provide accurate, complete, and updated account information including valid user name and email address as requested during site registration and profile update. Failure to do so shall constitute a breach of this agreement.

You may not use another registered users account information to access the web site. You also agree not to impersonate another user; provide email or user information that is either invalid or associated with someone else whether a registered user or an unaffiliated party; provide information that violates confidentiality, privacy, or intellectual property rights of others; or use degrading, violent, offensive or otherwise questionable language including user names, passwords, or when posting messages and content anywhere within the web site.

At our sole discretion, we may remove any information posted on the web site, including personal information. Similarly, we may disable any account that we believe is violating this agreement or appears to be of questionable use.

You are responsible for the protection of your account access information, including User ID, password, and password hint. If you believe your account information is compromised, please change your password immediately, and contact us for any additional changes you may require to your account.

Market Dynamix is not an investment advisory service or an investment advisor. Use of Site Content is at each user's sole discretion and risk. Market Dynamix, its parent, its affiliates, licensors, employees or officers, third party content providers, or other site users, collectively referred to as Site Content Providers, are not responsible for any investment decision made by you, regardless of the nature, phrasing, or leaning of any Site Content including research, chart data, messages, recommendations, opinions, emails or online communications, or any other information or posting.

The Site Content may include errors, omissions, or inaccuracies. Please notify us if you observe any problems so that we can properly review and address them. Site Content Providers are not responsible for any errors, ommissions, inaccuracies, or disruptions to Site Content access regardless of whether Site Content Providers were made aware or notified of such error, ommission, or inaccuracy. The disclaimers of liability apply to any damages or injury caused by a failure of performance, error, ommission, interruption, deletion, defect, delays, malicious agents such as computer viruses, communication or system failures, theft, destruciton, or unauthroized access, alteration, or use of records, in all aspects of law covered under contract,tort, negligence, or willful misconduct, or under any cause of action. Users acknowledge that Market Dynamix or is parent is not liable for any defamation, offensive or illegal conduct of third parties including site users, and that any risk of injury rests entirely with each user.

User acknowledges that in no event will Market Dynamix, its parent, or other Site Content Providers will be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profit or trading opportunities) related to access and use or lack thereof of the web site or Site Content including all third party postings, or use and download of third party software such as Operating System, Internet browser, or other add-ons as may be required to access the Site Content. Regardless, in no event shall such liability exceed any amounts paid directly by a user to Market Dynamix in compensation for use of the web site for the immediately preceding month.

The web site may contain links to independently operated third party web sites as well as advertisers and other resources. Market Dynamix or its parent is not responsible for any service aspect of such third party sites, and in no circumstance shall be liable for any use associated with these third party web sites.

Market Dynamix does not endorse, warrant, or guarantee any product, service, opinion, advice, or other content provided by a third party through the web site or in association with the web site, and will not be a party to or monitor any interaction between users and third party providers. Such use is at a user's sole discretion and risk.

User agrees to indemnify and hold Market Dynamix, its parent, its employees, its officers, and its agents harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney and legal fees) arising from the use of this web site, violations of this agreement or other third party rights. This provision will not expire after a user discontinues use of the web site and any Site Content.

User is solely responsible for any information and content posted by the user on the web site or communicated by the user to other site users or anonymous parties. User shall ensure such content is free of any malicious agents such as computer viruses and complies with the site use policy and user agreement. User consets to follow all applicable local, state, federal laws and other regulatory rules and regulations and to conduct all interactions in a lawful and respectfull manner. User shall not post or communicate information that violates or infringes upon the rights of others, engage in threatening, abusive, offensive or defamatory acts, violate privacy or confidentiality of information, conduct unlawful or objectionable acts, solicit other users, compete with or deter others from using Market Dynamix web site or Site Content, conduct any promotions, sales activity, or otherwise impact in any way other users access and enjoyment of the web site. User shall be solely liable for any damages resulting from any infringement of Patents, Copyrights, Trademarks, proprietary or confidential rights, or any other harm related to the use of the web site.

Market Dynamix reserves the right to use and distribute any and all contributions and posting on the web site. Users expressly grant a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display all web site, email, or online contributions.

Market Dynamix or a user may terminate subscription services at any time. User is responsible for immediate payment of any outstanding purchase balances, must cease immediately all manners of use and access to the web site and Site Content, and must adhere to all provisions of this agreement related to Site Content which shall survive the termination of this agreement. User must submit a subscription cancellation request at the website or provide Market Dynamix with a written statement of termination through the Support area of the site.

User will not be charged for any services during the initial Free Trial period. Upon cancellation of subscription by either party, Market Dynamix will refund pre-paid payments for any remaining full months of service after adjusting rates for the used portion of service to the closest then published subscription option. User acknowledges that this policy allows Market Dynamix to offer improved pricing on long term subscriptions and manage its internal costs and service activities, and is not intended in any way to be punitive. No partial month refunds are available. No interest shall be accrued on any pre-payment or long term subscription.

This agreement and any operating rules for the web site constitute the entire agreement between the parties and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
